Copyright subsists in all original works, however there are significant exemptions from the Copyright Act in Australia.
The First is that any work may be copied for educational purposes so long as no more than 10% (Ten Percent) is copied, and
The second is that if any work is required as evidence in and Court proceedings, it is absolutely exempt from the Act
